Terms & Conditions

ProctorCam ("ProctorCam", "our") is a virtual proctoring service offered to test takers and organizations that administers tests online.

Virtual Proctoring is the act of a user sharing their desktop and webcam activity via the web with a member of ProctorCam. Desktop sharing is the act of a ProctorCam user allowing a ProctorCam staff member to view all activity on the users desktop.

WebCam sharing is the act of a user allowing ProctorCam to see activity happening near and/or around the users computer. Both webcam and desktop sharing of user activity is often required, recorded and monitored by ProctorCam.

Personal Information

ProctorCam collects User's ("User", "Your", "You", "Test Taker") data such as name, sex, age, user name, password email address, physical/mailing address, educational institutions, ID numbers given by user or by a relationship established between user's organization and ProctorCam, IP addresses, and type of computer. ProctorCam respects personal information and data captured both in text, video and audio format on ProctorCam's web properties, computers and servers of its users. At anytime, users have the ability to log on to their personal account and correct standard user information such as password, email address, mailing address or cancel their account.

Data Collection

Additional data such as test recordings will also be collected over the course of the Users use of our service such as video and audio. Data captured will only be shared with ProctorCam staff and organizations associated with your account unless in breach of our Code of Conduct or in violation of laws. ProctorCam is not held responsible for data captured as it relates to activity on your desktop and your webcam. Upon activation of the desktop sharing application and webcam, ProctorCam reserves the right to captured data and share with user's associated organization, user's organization staff, staff of ProctorCam and and any other necessary parties. ProctorCam may share your data in instance of a change in corporate structure, merger or buyout from another organization.

Payment

ProctorCam only reserves a time slot for users based on payment by user or institution and with pre-approval of the institution to use our services. Credit cards will be billed upon booking of a test. If you are running late to the schedule time, please inform ProctorCam by e-mailing help@proctorcam.com or calling us at 877-TES-T127. If the user need to reschedule or cancel, the user must do so at least 48 hours in advance of their test or the test will be billed for the full value of the exam. If no cancellation or rescheduling has been sent to ProctorCam via e-mail or phone from the user, ProctorCam will wait five minutes in the identified conference room. After five minutes, it is possible the user may forfeit their test slot and may be billed for the entire value of the exam.

Proctoring Intervention

User agrees to ProctorCam Code of Conduct and their affiliated organizations guidance, rules and/or regulations associated with their test. ProctorCam also reserves the right to address with user during the test the use of materials not outlined by user or testing administrator/organization prior to the beginning of the test. User reserves the right to continue using said material however ProctorCam will share and address with test taker, organization officials. Users reserves the right to address issues outside of ProctorCam with their associated organizations to address the data. Data will be available to all necessary parties for help in determining violation of Code of Conduct or organization guidelines for testing. ProctorCam will only intervene if the data and/or user activity is illegal and/or upon the request of associated organization or user.

Limitation of Liability

ProctorCam is not liability related to technical errors, data captured or outcome of your test/certification/degree arising out of use of our services shall not exceed the cost of the test.

Indemnity

User agrees to indemnify ProctorCam and affiliates liable for use of our services, the outcomes associated with it including but not limited to test score, organization's acceptance of our proctoring service, loss of wages/monies, legal fees filed by you or on your behalf.

Cookies

ProctorCam also uses cookies to help with navigation of our site. Cookies allow ProctorCam to identify new users from established users to help us fine tune our website. No personal information is stored in the cookie. You may disable or set your computer to alert you to the installation of a cookie but will hinder your experience using our site.

Communication With Users

Time to time ProctorCam will contact our users via email, phone, US mail. ProctorCam knows it is important to respect our users time and relationship with us however we will time to time have information about your account that may be of interest to the user or to inform you to a change in your account.

COPPA

In compliance with the Child Online Privacy Protection Act, ProctorCam does not actively recruit users or allow the collection of identifiable data of users if under the age of 13 years old.

ProctorCam, this website and associated ProctorCam logo and the phrase "ProctorCam" is protected under US law and are proprietary to ProctorCam. No proprietary marks, logos or parts of the ProctorCam site may be uses without prior written consent of ProctorCam.
